We have clear priorities.

 

Modernize the application.

  • Application process is dated.

  • Paper-based systems create:

    • inefficiencies in information sharing;

    • errors and omissions; and

    • missed opportunity to create a valuable database for stronger enforcement strategies.

  • 100% digital process will simplify the submission for the applicant and improve the accuracy and availability of information.

Review temporary licensing.

  • Support temporary licensure to:

    • help businesses establish distributor relationships; and

    • set-up their service operations and initiate revenue generation.

  • Should be actively managed to:

    • ensure good standing;

    • reduce extensions; and

    • hold expired violators accountable.

Expand audit program.

  • Expand recently passed 20-O-1741 legislation to annually audit more than 1% of licensees and audit across multiple categories of licensees.

  • Legislate selection parameters to create a transparent audit process and allow the audit tool to be used to address concentrated issues.

Strengthen enforcement.

  • Atlanta City Council should pass new enforcement legislation that empowers the APD, LRB and NPUs to take swift action to effectively address bad operators with legal confidence including:

    • temporary closures;

    • renewal blackout periods;

    • earlier license revocation; and

    • punitive fines.

Establish LRB procedural policies

  • Legislate (as needed) and otherwise document procedural standards for the License Review Board.

  • Policies that are not codified in the City of Atlanta Code of Ordinances are made publicly available.

Address available resources.

Currently, APD licensing departments are grossly understaffed. Expand APD funding for License & Permit Division to deepen the bench to improve:

  • accuracy of application submission;

  • response time to NPU inquiry;

  • enforcement response; and

  • ability to prepare Due Cause packages.

Revise definitions.

  • Businesses should be licensed accurately per code definition and audited regularly for compliance.

  • Definitions of categories should be reviewed and revised to be more specific.

  • Additional categories should be considered to address development trends.

Align 10 & 16.

Ch. 10 = Alcohol Licensing Ch. 16 = Zoning

  • Align and eliminate any conflicts.

  • Office of Zoning and Development should:

    • complete a transparent and documented review of zoning related questions; and

    • present findings at LRB.

Expand NPU role.

Neighborhood Planning Unit (NPUs) should have a codified right to:

  • present at all NPU denials and Due Cause hearings as a recognized stakeholder;

  • initiate a Due Cause hearing after meeting an established burden of proof; and

  • appeal a decision of the LRB or Mayor’s office when licensee is granted a permit following a NPU denial.

Review APD Extra Job program.

  • APD should establish a documented system of accountability including:

    • required permits;

    • framework for suspension; and

    • performance reviews.

Normalize internal audits.

  • City Council and Mayor’s Office should use the Office of the Inspector General to conduct periodic, and at least annual, review of LRB and APD License and Permits actions.
